Innovative Investments LLC , herein referred to as Top Tanoor, provides this Voluntary Warranty to you at no additional cost and contains information on how to have your Top Tanoor product repaired in the unlikely event of a defect or failure.
In accordance with applicable laws, customers have several rights in case of product defects, including supplementary performance or replacement, a reduction in the purchase price, and compensation. In the European Union, for example, there is a two-year statutory warranty that begins on the date of the product handover. This warranty provision does not affect these and other statutory rights. In fact, this warranty grants additional rights to the owner that are independent of statutory warranty provisions.
Top Tanoor provides a warranty to the purchaser of the Top Tanoor product (or in the case of a gift or promotional situation, the person for whom it was purchased) that the product is free from defects in material and workmanship for the specified period(s) of time, as long as it is assembled and operated in accordance with the accompanying Owner's Guide. Under normal, private single-family home or apartment use and maintenance, Top Tanoor agrees, within the framework of this warranty, to repair or replace defective parts within the applicable time periods, limitations, and exclusions listed below. This warranty only applies to the original purchaser and is not transferable to subsequent owners, except in the case of gifts and promotional items.
To ensure trouble-free warranty coverage, it is recommended that you retain your original sales receipt and/or invoice as it is important for warranty coverage. The warranty only applies if the owner takes reasonable care of the Top Tanoor product by following all assembly instructions, usage instructions, and preventative maintenance as outlined in the accompanying Owner’s Guide.
If you believe that you have a part that is covered by this warranty, please contact Top Tanoor Customer Service using the contact information on our website (www.TopTanoor.com, or such country-specific website to which the owner may be redirected). Top Tanoor will investigate and repair or replace (at its option) a defective part that is covered by this warranty. If repair or replacement is not possible, Top Tanoor may choose (at its option) to replace the cooker in question with a new cooker of equal or greater value. Top Tanoor may ask you to return parts for inspection, and shipping charges should be pre-paid.
This warranty lapses if damages, deteriorations, discolorations, and/or rust are caused by abuse, misuse, alteration, modification, misapplication, vandalism, neglect, improper assembly or installation, failure to perform normal and routine maintenance and cleaning, failure to store in a low humidity environment, insects, rodents, exposure to salt air and/or chlorine sources such as swimming pools and hot tubs/spas, or severe weather conditions. Additionally, the use and/or installation of parts on your Top Tanoor product that are not genuine Top Tanoor parts will void this warranty, and any resulting damages are not covered by this warranty. Any conversion of a gas cooker not authorized by Top Tanoor and performed by a Top Tanoor authorized service technician will also void this warranty. The cookers shown in this Owner's Guide may differ slightly from the model purchased.
DISCLAIMERS
Except for the warranty and disclaimers stated in this warranty statement, Top Tanoor does not provide any other warranty or voluntary declarations of liability beyond the statutory liability that applies to them. This warranty statement also does not limit or exclude situations or claims where Top Tanoor has mandatory liability as prescribed by statute. The exclusive remedy of this warranty is repair or replacement of the part or product, and no warranties apply after the applicable periods of this warranty. Top Tanoor is not bound by any other warranties given by any person, including a dealer or retailer, with respect to any product, such as any "extended warranties." In no event under this voluntary warranty shall recovery of any kind be greater than the amount of the purchase price of the Top Tanoor product sold. You assume the risk and liability for loss, damage, or injury to you, your property, and/or to others and their property arising out of the misuse or abuse of the product or failure to follow instructions provided by Top Tanoor in the accompanying owner's guide. Parts and accessories replaced under this warranty are warranted only for the balance of the above mentioned original warranty period(s). This warranty applies to private single family home or apartment use only and does not apply to Top Tanoor cookers used in commercial, communal or multi-unit settings such as restaurants, hotels, resorts, or rental properties. Top Tanoor may change the design of its products from time to time, and nothing contained in this warranty shall obligate Top Tanoor to incorporate such design changes into previously manufactured products, nor shall such changes be construed as an admission that previous designs were defective.
